No, most of the time. In Washington, there are several methods of transfering property upon your death. A quit claim gives your child an immediate ownership interest in your property. It is usually best for a heir to recieve the step up in basis for the home rather than putting them on the title. Most real estate issues stem from the unintended consequences of these types of transactions. It is always best to discuss your options with an attorney before adding someone to the title of your home.
I can help you, but I am a private attorney and require payment upfront to repesent clients.
However, there are several free services available to you. Please contact the Washington Homeowners Assistance Funds at https://washingtonhaf.org/.
They assist you in obtaining a free housing counselor who may assist you in evaluating resources, completing modification requests, and applying for grants to allow you to remain in your home. If for some reason they cannot assist you, then call me to determine if there is anything I can do to assist. However, you must have contacted a housing counselor and tried using the free resources available before we will accept your case.
Please visit our practice areas page to see the type of cases that we acccept. Our main practice areas are real estate, estate planning, foreclosures, and consumer protection with occassional business clients.
We accept a limited number of consumer protection litigations due to the size of the firm. Call us for a consultation.
If it was your spouse and both spouses are on title to the property, we can assist you.
Otherwise, if the property was separate property or if it was a parent and the children are inheriting either by Will or intestacy (without a will), our firm no longer handles probate matters.
Please contact Wendy Harris of Harris Law Office to discuss your options.
